Silvia Carter, spokesperson for the Platform for International Cooperation on Undocumented Migrants, warned that Europe risks replicating the "violence and fear created by ICE's brutal immigration enforcement." French Green Party lawmaker Mélissa Camara called the deal "a historic setback" for human rights, citing provisions that legalize return hubs outside the EU, allow detention of minors, and authorize home visits inspired by U.S. Immigration and Customs Enforcement practices.

Activist groups, including the International Rescue Committee, cautioned that the legislation would expand government powers to detain and deport individuals, normalize immigration raids, and increase the risk of deporting people to countries where they could face persecution or torture. The EU has tightened migration policies following a rightward political shift in 2024, fueled by anti-immigrant sentiment similar to that seen in the United States.

European Commission President Ursula von der Leyen said the measures aim to prevent a repeat of the 2015 refugee crisis, when about 1 million asylum seekers arrived due to Syria's civil war.

The provisional agreement now requires approval from EU lawmakers and heads of state, which is expected to be swift.
