Oakland Council Deadlocks on $1M Fine for Illegal Tree Removal

The Oakland City Council is gridlocked over whether to levy a nearly $1 million fine against property owners for illegally cutting down 38 protected trees. Property owners Matthew Bernard and Lynn Warner cut down the trees on a Claremont Avenue lot between 2021 and 2022 without permits, despite multiple warnings.

Councilmember Janani Ramachandran supports the full $915,135 fine, calling it the city's worst tree violation, while others like Carroll Fife cite concerns over racial equity in enforcement. The council tied on enforcing the full fine and rejected a reduced penalty, postponing a final decision until May 5.

The case highlights a conflict between strict enforcement of environmental laws and concerns about historical inequities in how such rules are applied.
